Terms of Service

These Terms of Service ("Terms") govern your use of arcanamaze (the "Service"). By using the Service, you agree to be bound by these Terms.

If you are a consumer in the European Economic Area (EEA), United Kingdom, or other jurisdictions with mandatory consumer protection laws, these Terms do not limit any rights that cannot be waived by law.

1. Description of Service

The Service is a web application that provides tarot card divination experiences and life log recording. It offers the following features:

  1. Daily Oracle (daily tarot card reading)
  2. Life log recording (mood and note tracking)
  3. Full Reading (full tarot reading experience using Canvas)
  4. Timeline and reflection features
  5. Tarot Guide (educational content)
  6. AI reading interpretation (paid plans)

2. Accounts

  1. The Service can be used without creating an account for basic features
  2. When creating an account, please provide accurate information
  3. You are responsible for managing your own account and maintaining the confidentiality of your login credentials
  4. Creating multiple accounts per person is prohibited
  5. Please update your information promptly if it changes
  6. We may suspend or terminate accounts that violate these Terms

3. Fees and Subscriptions

  1. Basic features of the Service are available free of charge
  2. Paid plans (PRO, PLUS) are billed on a monthly subscription basis
  3. Pricing and details of paid plans are displayed separately within the Service
  4. Paid plans renew automatically. If cancellation is not completed before the renewal date, charges for the next period will apply
  5. Fees already paid are non-refundable, except as required by applicable law
  6. EU/EEA consumers: You have the right to withdraw from a digital content purchase within 14 days of subscription, unless you have expressly consented to the immediate provision of the service and acknowledged the loss of your right of withdrawal

4. Data Usage

  1. We may use data entered by users (oracle records, mood records, notes, etc.) in anonymized, aggregated form for the following purposes:
    1. Service improvement and new feature development
    2. Creating statistical data and analysis
    3. Training and improving AI (artificial intelligence) models
    4. Research purposes
  2. In such use, we completely remove users' personal information (name, email address, user ID, etc.) so that no specific individual can be identified
  3. Users may stop further data usage by deleting their account. However, data that has already been anonymized and aggregated at the time of deletion cannot be attributed to any individual and is therefore excluded from deletion

5. Intellectual Property

  1. The copyrights and other intellectual property rights of content included in the Service (text, images, software, design, etc.) belong to us or their rightful owners
  2. The copyright of data entered by users (notes, questions, etc.) belongs to the users
  3. Users grant us a non-exclusive, worldwide, royalty-free license to use their data within the scope defined in Article 4. This license terminates when you delete your account, except for data already anonymized

6. Prohibited Activities

Users shall not engage in the following activities when using the Service:

  1. Activities that violate applicable laws or regulations
  2. Activities that infringe on the rights of other users or third parties
  3. Activities that interfere with the operation of the Service
  4. Unauthorized access, reverse engineering, or scraping
  5. Unauthorized reproduction or redistribution of Service content
  6. Commercial activities using the Service (except as permitted under the PLUS plan)
  7. Registering false information
  8. Impersonating other users

7. Disclaimer Regarding Divination Results

  1. Divination results provided by the Service are offered for entertainment and self-reflection purposes only
  2. Divination results are not a substitute for medical, legal, financial, or other professional advice
  3. We assume no responsibility for users' decisions or actions based on divination results
  4. If you have concerns about your physical or mental health, please consult an appropriate professional

8. Service Modification, Suspension, and Termination

  1. We may modify the content of the Service. For material changes that negatively affect you, we will provide reasonable prior notice
  2. We may temporarily suspend the Service in the following cases:
    1. System maintenance or inspection
    2. Natural disasters, power outages, or other force majeure events
    3. Other cases where we determine suspension is necessary
  3. We may terminate the Service by notifying users at least 30 days in advance
  4. Upon termination, we will provide a reasonable period for users to export their data

9. Limitation of Liability

  1. The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  2. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  3. In cases where we are liable, our total liability shall be limited to the total fees paid by you in the most recent 12-month period, or USD $100, whichever is greater
  4. Nothing in these Terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law

10. Dispute Resolution

  1. We encourage you to contact us first to resolve any disputes informally
  2. If a dispute cannot be resolved informally within 30 days, either party may pursue formal resolution
  3. For users outside the EU/EEA: These Terms are governed by the laws of Japan. Any disputes shall be subject to the jurisdiction of the Tokyo District Court
  4. For EU/EEA consumers: You may bring proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform. Mandatory consumer protection laws of your country of residence will apply where they provide greater protection

11. Changes to These Terms

  1. When modifying these Terms, we will notify users of the changes and effective date within the Service
  2. For significant changes, we will provide notice at least 14 days before the effective date
  3. Continued use of the Service after the effective date constitutes acceptance of the modified Terms
  4. If you do not agree to the modified Terms, you may stop using the Service and delete your account

12. General Provisions

  1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect
  2. Our failure to enforce any right or provision does not constitute a waiver of that right
  3. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service
